Sattar&Co. represented a prominent engineering company in Bangladesh against a Government-owned power distribution company. The dispute involved a supply-agreement between the parties and invoking the force majeure clause for the non-performance of the contract due to COVID-19, whereby the company sought to restrain the other party from encashing the performance guarantee. Our firm filed a Writ on behalf of the company and was able to obtain an order to maintain status quo with regards to encashment of performance guarantee until disposal of the dispute through arbitration.
